Terms of Service

EFFECTIVE OCTOBER 7, 2026LAST UPDATED OCTOBER 7, 2026

These terms apply to your use of this website and to any services you buy from Systemside. Please read them before you sign up.

1. Agreement

"Systemside", "we" and "us" means SystemSide, registered in Blagoevgrad, Bulgaria. "You" means the business or person using the site or buying services. By using the site or accepting a proposal, you agree to these terms. If a signed proposal or service agreement conflicts with these terms, the signed document wins.

2. Our services

We provide marketing and growth services for service businesses, which may include paid advertising, creative and social media content, websites and landing pages, and setup and management of a customer communication platform provided with our partner Extendly. The exact scope, deliverables and timelines for your plan are set out in your proposal. Work outside that scope is quoted separately.

3. Fees and payment

  • Fees are billed monthly in advance, in the currency shown on your proposal, unless agreed otherwise.
  • Advertising spend is paid by you directly to the ad platforms and is not included in our fees.
  • Platform fees are billed by Extendly at cost under its own terms. We do not mark them up.
  • Invoices are due within 7 days. If a payment is more than 14 days late, we may pause work and campaigns until it is settled.
  • Fees exclude applicable taxes, which you are responsible for.

4. Term and cancellation

Growth plans run month to month and can be cancelled with 30 days' written notice. Enterprise plans have a 12-month minimum term, as stated in your proposal, then continue month to month. Either party may end the agreement immediately if the other seriously breaches it and does not fix the breach within 14 days of notice. Fees for work already delivered remain payable. On cancellation we will hand over your accounts, files and completed deliverables once all invoices are paid.

5. Your responsibilities

  • Give us accurate information, timely feedback and the access we need to do the work.
  • Make sure you have the rights to any logos, photos, text or other material you send us.
  • Make sure your offers, prices and claims in ads and on your website are truthful and lawful.
  • Keep your account logins secure and tell us about any unauthorised access.

6. Calls, texts and consent

When the platform calls, texts or emails your customers on your behalf, you are the sender. You are responsible for having the consent the law requires, including under the TCPA, CAN-SPAM, GDPR and carrier rules for business texting, and for honouring opt-out requests. You must not use the platform to send spam or unlawful content. We may suspend messaging that puts your account, our partners or carriers at risk.

7. Third-party platforms

Our work relies on platforms we do not control, such as Extendly, Meta, Google and website hosts. Your use of them is also subject to their own terms. We are not responsible for their outages, policy changes, ad rejections or account restrictions, but we will help you resolve them.

8. Ownership and portfolio

Once you have paid for them in full, you own the final deliverables we create for you, such as ad creative, designs, copy and website content. We keep ownership of our templates, tools, methods and pre-existing work, and give you a licence to use any of them included in your deliverables. Unless you ask us not to in writing, we may show completed work and your business name in our portfolio and marketing.

9. Results

We work hard to grow your business, but results depend on many things outside our control, including your market, offer, pricing, budget and how quickly you respond to leads. We do not guarantee any specific number of leads, bookings, sales or return on ad spend. Any figures in case studies describe past client work and are not a promise of future results.

10. Confidentiality

Each party will keep the other's non-public business information confidential and use it only for the engagement. This continues for two years after the engagement ends. Personal data is handled as described in our Privacy Policy.

11. Warranties and liability

We will provide the services with reasonable skill and care. Apart from that, the services and website are provided "as is", to the extent the law allows. Neither party is liable for indirect or consequential losses, or for lost profits, revenue or data. Our total liability under any engagement is limited to the fees you paid us in the three months before the claim. Nothing in these terms limits liability that cannot be limited by law.

12. Indemnity

You agree to cover our reasonable costs from third-party claims caused by material you provided, your products or claims, or messages sent from your account without the required consent.

13. Use of this website

The content on this site, including the case studies shown, belongs to Systemside or our clients and is for information only. Don't copy it, scrape it or use it to build a competing service. Client logos and work are shown with permission and remain the property of their owners. Links to other sites are provided for convenience; we are not responsible for their content.

14. Disputes

Both parties will first try to resolve any dispute in good faith.

15. Changes and contact

We may update these terms. Changes apply to new engagements straight away and to existing clients 30 days after we notify them by email.
